The primary duty of care between the labour hire agency and host employer is not always clear. This can lead to a situation where one party has an expectation of the other party to look after health and safety.
Do not assume that someone else is responsible for WHS matters.
It must be understood that it is a shared responsibility, achieved through the two parties collaboratively communicating and consulting with each other to ensure a clear understanding of WHS duties of each party is established.
The Supplier is to ensure that any mandatory inductions or WHS courses required prior to the work start date have been completed. These mandatory WHS requirements / courses shall be communicated during the consultation stage of the engagement by the Optus representative at the time.
Once employment has commenced, additional WHS courses may need to be completed. Any additional courses will be allocated via the Optus Learning Platform and notified to the personal via Optus internal email.
