In these Terms:
Optus, we, us means Optus Mobile Pty Ltd, Optus Networks Pty Ltd and our related bodies corporate.
You, your means the individual using the Optus Digital ID Service.

1. Overview of the Optus Digital ID Service
1.1 The Optus Digital ID Service allows you to submit identity information and supporting documents so we can verify your identity securely and efficiently. Verification may include:
- capturing and checking your identity document(s), such as an Australina driver's licence, or a passport issued by Australia or another government.
- using the Australian Government's Document Verification Service (DVS) to confirm authenticity of documents
- capturing your facial biometrics and performing a liveness check
- comparing your selfie or biometric sample to the photograph on your identity document
2. Eligibility
2.1 You must be at least 18 years old to use the Optus Digital ID Service.
2.2 By using the service, you represent and warrant that:
- you are at least 18 years old;
- the information you provide is accurate and your own; and
- your use of the service complies with all applicable laws.
3. Using the Optus Digital ID Service
3.1 To use the service, you must:
- Provide certain personal information (such as your name, date of birth, address or contact details).
- Allow capture of identity documents via photo, which must be captured in real-time and cannot be uploaded.
- Provide a selfie or other biometric sample for identity matching and fraud prevention.
- Provide your express consent to allow Optus to verify your information against issuing authorities via DVS and, where required, biometric matching services.
3.2 You must ensure all information you provide is accurate and complete. You are responsible for updating us if any information changes or is incorrect.
4. Identity Checks and Verification
4.1 By using the service, you authorise Optus to:
- verify your identity using government, regulatory and third-party systems (including DVS and biometric matching services)
- conduct fraud prevention, anti-impersonation and liveness checks
- request additional information or documents if required
- re-verify your identity in the future if needed (including in cases of suspected fraud or account takeover)
4.2 You agree to provide reasonable assistance and accurate information for these checks.
5. Your Licence to Use the Service
5.1 Limited Licence
Optus grants you a personal, non-exclusive, non-transferable, revocable licence to use the Optus Digital ID Service solely for your own identity verification when dealing with Optus.
5.2 Restrictions
You must not:
- copy, modify or interfere with the service
- reverse engineer or circumvent security controls
- use the service for any unlawful, fraudulent or unauthorised purpose
- permit others to access your verification session or materials
5.3 Feedback
If you give Optus feedback or suggestions, you grant Optus a right to use that feedback for any purpose.
6. Ownership and Intellectual Property
All software, documentation, interfaces, designs, processes and materials used in or provided through the Optus Digital ID Service are owned by Optus or its service providers. You obtain no rights in them except as expressly granted under these Terms.
7. Third-Party Services
7.1 Verification Partners
The Optus Digital ID Service uses third-party systems (including DVS, biometric matching providers, and document authentication technologies) to perform identity checks.
By using the service, you consent to Optus sharing your information with these providers solely for identity verification. Third-party systems are outside Optus' control. To the extent permitted by law, Optus is not responsible for their actions or decisions.
7.2 Software Components
The Optus Digital ID Service may include software or tools provided by third parties. Your use of these components may also be subject to their licensing terms.
8. Prohibited Conduct
By using the Optus Digital ID Service you agree not to:
- use the Optus Digital ID Service for any illegal purpose or in violation of any applicable law;
- violate, or encourage others to violate, any right of a third party, including by infringing or misappropriating any third party intellectual property right;
- interfere with security-related features of the Optus Digital ID Service, including by:
- disabling or circumventing features that prevent or limit use or copying of any content; or
- reverse engineering or otherwise attempting to discover the source code of any portion of the Optus Digital ID Service except to the extent that the activity is expressly permitted by applicable law;
- interfere with the operation of the Optus Digital ID Service or any user's enjoyment of the Optus Digital ID Service, including by:
- uploading or otherwise disseminating any virus, adware, spyware, worm, or other malicious code;
- making any unsolicited offer or advertisement to another user of the Optus Digital ID Service;
- collecting personal information about another user or third party without consent; or
- interfering with or disrupting any network, equipment, or server connected to or used to provide the Optus Digital ID Service;
- perform any fraudulent activity including impersonating any person or entity, claiming a false affiliation, accessing any other ID Service account without permission, or falsifying your age or date of birth;
- sell or otherwise transfer the access granted under these Terms or any Materials or any right or ability to view, access, or use any Materials; or attempt to do any of the acts described in this Section 8 or assist or permit any person in engaging in any of the acts described in this Section.
9. Privacy – Optus Digital ID Service Collection Notice
- When you use the Optus Digital ID Service, Optus Mobile Pty Ltd, Optus Networks Pty Ltd and their related bodies corporate ( "Optus", "we", "us" or "our") is collecting your name, date of birth, address or contact details, images of your identity document(s) (such as an Australian driver's licence, or a passport issued by Australia or another government), your photograph or selfie, and facial biometric and liveness detection information, through the Optus Digital ID Service, for the following purposes:
- to verify your identity and to re-verify your identity in the future if needed, before supplying particular products or service;
- to confirm the authenticity of identity documents;
- to detect, investigate and prevent fraud, impersonation and misuse;
- to investigate and resolve complaints, incidents or disputes;
- for law enforcement purposes; and
- to comply with legal and regulatory obligations.
- If you do not provide the requested personal information, biometric information, identity documents you will not be able to use the Optus Digital ID Service to verify your identity to Optus. (If you’d prefer not to use the Optus Digital ID Service, we can verify your identity by checking your ID details against official records through the DVS, or by completing a manual ID check using your ID documents. Neither of these methods involve the capture or retention of the image of your identity document or biometric information). Please speak with the team member assisting you.)
- The Optus Digital ID Service uses third-party systems (including DVS, biometric matching providers, and document authentication technologies) to perform identity verification checks, and Optus will share your information with these providers solely for the purposes outlined above. Some of our service providers and technology partners may be located outside Australia or may access information from outside Australia. Information about the countries where Optus may disclose information to is available in the Optus Privacy Policy.

10. Modification of these Terms
We reserve the right to change these Terms on a going-forward basis at any time, provided that any changes will be compliant with applicable laws (including privacy laws) and the Optus Privacy Policy. By continuing to use the Optus Digital ID Service after a change, you are indicating your acceptance of those changes.
11. Term, Termination and Modification of the Optus Digital ID Service
11.1 Term. These Terms are effective beginning when you accept the Terms or first download, install, access, or use the Optus Digital ID Service, and ending when terminated as described in Section 11.2.
11.2 Termination. We may terminate these Terms of Use and cease providing the Optus Digital ID Service to you at any time in our discretion without notice.
11.3 Effect of Termination. Upon termination of these Terms:
- your license rights will terminate and you must immediately cease all use of the Optus Digital ID Service;
- you will no longer be authorized to access your account or the Optus Digital ID Service; and
- Sections 3, 4, 5.2, 5.3, 6, 7.1, and 11.3, 12, 13 and 14 will survive.
11.4 Modification of the Optus Digital ID Service. We reserve the right to modify or discontinue the Optus Digital ID Service at any time (including by limiting or discontinuing certain features of the Optus Digital ID Service temporarily or permanently, without notice to you). To the extent permitted by law, we do not represent, warrant or guarantee the suitability, completeness, accuracy or currency of any information or content accessed via the Optus Digital ID Service, or that the Optus Digital ID Service will be uninterrupted, timely, error-free, free of viruses, intrusion or other harmful components.
12. Liability
The liability clauses under the Optus Customer Terms of the Standard Agreement apply to any services provided under these Terms (with the necessary changes having been made to give effect to this). Optus and its related bodies corporate are not liable in connection with any acts or omissions of any third parties (including Relying Parties) in relation to any use or disclosure of your ID information or attributes, where you have consented to the provision of that information to those third parties.
13. Inconsistency
If these Terms conflict with the Optus Standard Agreement, the Standard Agreement prevails to the extent of the inconsistency, unless otherwise stated.
14. Governing Law
These Terms are governed by the laws of the Commonwealth of Australia and the state or territory where you ordinarily reside. You submit to the exclusive jurisdiction of those courts.
