Our Legal Obligations to Share Information

In certain situations, we may be required to provide information and assistance to authorised government agencies, including law enforcement and emergency services.

Our obligations

Optus has obligations relating to the privacy of its customers' records and information and must follow strict processes to manage the disclosure of customer records to Police, or in response to a subpoena, warrant or other legal document.

NOTE: Certain types of information do not require a subpoena, court order or legal notice, and may be provided directly to customers upon request. For further details on the types of data available in this manner and how to request it, please refer to: Request your data.

How can requests be made

Government agencies, Law Enforcement and Emergency Services

There are formal channels for Government agencies, law enforcement and emergency services to engage with Optus and request information from us, and they are required to contact Optus via those channels.

Subpoenas, court orders and Legal notices

All subpoenas, court documents and legal notices must be served to the correct entity as per below:

If the records relate to more than one (1) entity, a separate subpoena/order/notice is required for each entity.

Please provide the court address of where the produced documents/information is to be sent to and/or the Registrar’s email address, to help with any follow-up required and prevent delays should the courts not receive the produced material.

All subpoenas, court orders and legal notices should be sent via email to LELU.Statements@optus.com.au 
NOTE:  Whilst subpoenas can be mailed to the physical address listed in the table above, we recommend email instead, to avoid delays.

Costs

Please note that charges apply to the provision of Optus records (known as ‘conduct money’), enabling Optus to cover its reasonable expenses for the time and effort taken to provide the records.  The cost can be paid via bank transfer. If required, we will contact you with the details of the cost before data is provided.
