What is meant by ‘good working order’?

The phone needs to be in "good working order", when you return it either for an upgrade or at the end of your lease. This means the phone is fully functional - that is, it makes and receives calls and texts, connects to the internet, and is not physically damaged, except for normal wear and tear as reasonably determined by us. For example, the phone:

  • Can power on and off.
  • Has a fully functional touchscreen and battery.
  • Is not physically damaged (e.g. does not have liquid damage, cracked, discoloured or bleeding screen (LCD) or casing, does not have any missing buttons or damage to other components such as charging ports or SIM tray).
  • Does not have any missing, disassembled, customised or non-genuine parts (this does not affect your rights under the Australian Consumer Law).
  • Is not cracked (including the touchscreen) and does not have any severe scratches (normal wear and tear such as light marks and scratches are okay).
  • Has any locking features disabled (for example, find my iPhone on iOS devices).
  • Is not IMEI blocked.
  • Is the phone you leased from us under the mobile equipment lease plan.

You'll also need to make sure that the phone is in return condition. Make sure you back up your data and then delete your personal/confidential information. You'll also need to perform a factory reset and remove the SIM and any memory cards, plus disable all locking features. Additionally, you'll need to provide all documentation reasonably requested by us to help make sure the phone you're returning is the same phone we leased to you.

Optus My Plan Business Flex Plans: My Plan Business Flex plans (excludes Tech Fund) allow you to lease an eligible device on a 24 month plan and use it to access the Optus network. You do not own the device and you must return the device to Optus in good working order at the end of your contract. If it is not in good working order, you'll pay a damage fee of up to $499. If the phone gets damaged during your lease and you'd like to have it fixed, you need to pay to have it repaired by Optus or the manufacturer (excludes warranty/consumer guarantee claims).

You can offer to purchase the device at the end of your 24 month lease contract for fair market value (which we'll advise at the time).

If you don't return the device at the end of your contract term, you'll continue to pay monthly device charges for up to 6 months (as well as your plan fees). At that point, if you still don't return the device, you will have to pay us a non-return fee (the fair market value of the device which we'll advise at the time) and you will own the device.

After 12 months you can upgrade the device by paying a one-off fee of $99. To do this you need to return the current device in good working order to Optus and get a new device on a new 24-month plan. If the current device is damaged, you'll pay a damage fee. If you don't return the current device within 14 days of your new contract you'll have to pay for the device at its fair market value.

My Plan Business Flex Cancellation: If you cancel at any time within the 24 month contract term you will be charged a plan cancellation fee, pro-rated monthly for your remaining contract term. Additionally, if you cancel in the first 18 months you'll have to keep the phone and pay all monthly device charges (which will be increased by any device credits lost as a result of early cancellation) for the remainder of the contract term. If you cancel in the last 6 months of your 24 month contract, you can either return the device to us or make an offer to purchase it at fair market value (which we'll advise at the time). If you choose to return the device, you'll pay $99 if it's in good working order or a damage fee of up to $499 if it's damaged.

My Plan Business Cancellation: Excludes My Plan Business (Tech Fund) plans. Your phone repayments are reduced by a monthly credit. If you need to cancel your plan there are no plan cancellation fees, simply pay out the full remaining cost of your phone which will include any amount that Optus was going to cover.

New Phone Trade Up: Not available on My Plan Business (Tech Fund) plans. After 12 months you can pay a one-off fee of $99, return your current device in good working order to a Yes Optus store and buy a new device on a new 24-month plan. Alternatively if you wish to keep your original device simply pay out the full remaining cost of your device including any amount that Optus was going to cover, then upgrade to a new device on a new 24-month plan. Mobile TV Streaming Offer: Sign up/recontract to selected My Plan Plus/My Plan Flex/My Plan Business/My Plan Business Flex plans by 4/6/17 and get access to data free mobile TV streaming on selected streaming apps at no additional cost. Your bill will show a $10 charge for this and corresponding credit. It may take up to 4 days to activate Mobile TV streaming from when you receive the handset.

Mobile TV & Music streaming: All for use in Australia. Fair Go Policy applies. For personal use only. Stream SD video up to 1.5Mbps & music up to 512kbps. Some streaming services require paid subscriptions. Streaming services subject to change at any time. Content such as ads, authentication & app analytics are excluded and will incur data charges. Streaming services may not have apps available on all mobile operating systems. Suitable for one stream per service on mobile & tablet devices only. Mobile broadband customers will need an Optus mobile/home broadband service to get Yes TV by Fetch.

Yes TV by Fetch Mobi app: Yes TV by Fetch Mobi app only available for use within Australia to selected new and recontracting Optus mobile customers (purchased via online only). Mobile and Home Broadband data charges will apply unless you are subscribed to Mobile TV streaming package or have an Optus Home Broadband Unlimited Data plan. You must subscribe to a Yes TV by Fetch Ultimate pack to access content. Available to download on compatible smartphones and tablets with an eligible operating system (not available via PC & Mac). Yes TV by Fetch Mini: Requires an active fixed broadband Internet connection and a download speed of at least 3Mbps, a widescreen TV and an external antenna connection. Data charges will apply from your internet service provider if you’re not using Optus fixed broadband. Any purchased content such as Movie and TV store content will be charged to the Optus postpaid mobile bill that is associated with the Yes TV by Fetch Mini subscription. Yes TV by Fetch Mini cannot tether data from a mobile device which means you cannot use your mobile data to watch content from the Yes TV by Fetch Mini. Yes TV by Fetch mini cannot be used for any commercial business purposes. If mobile service is cancelled Yes TV by Fetch Mini service will also be cancelled. If the Yes TV by Fetch Mini service is cancelled you must return the device to Optus or charges will apply.

Optus Sport: Personal viewing in Australia only. Content and features vary by device and sport. Sport coverage is available as long as you remain on an eligible plan and Optus has the rights. Optus Sport is a month-to-month subscription, which will continue until you cancel your subscription or you move to an ineligible plan. Where your plan includes Optus Sport at no additional cost, your bill will show a $15 charge and corresponding credit.

International Roaming Inclusions: $105 and $130 and $160 My Plan Business/My Plan Business Flex give you unlimited standard national and international talk, SMS (excludes MMS) and an included amount of data to use in Zone 1 countries per month. Optus Travel™ Pack: Gives you unlimited standard national and international talk, SMS and up to 100MB of data to use in Zone 1 countries per day. For list of countries see optus.com.au/travel. You must activate each day of Optus Travel™ Pack prior to use and if you activate multiple consecutive days, the data allowance will accumulate for use anytime over the consecutive day period. If you exceed your daily or accumulated usage, standard data roaming charges will apply. You can also purchase additional Optus Travel™ Packs. Any data provided as part of an Optus Travel™ Pack is not shareable and will not form part of any Data Pool. Any un-used days of Optus Travel™ Pack are forfeited and cannot be rolled over to the next billing month.

National Talk Inclusions: Can be used for standard talk to Oz numbers, 13/1300 numbers and voicemail retrievals all within Australia.

Data Pool: If you have more than one My Plan Plus (including SIM Only), My Plan Flex, My Plan Business (including SIM Only & Tech Fund), My Plan Business Flex, My Mobile Broadband Plus or Mobile Broadband Business plan on the same billing account, the included monthly data allowance will combine into one data pool, which will be shared by all eligible services on that account. This data can also be shared with any existing Share Data Plan. Any unused data in the data pool expires at the end of each billing month.

Additional Data: Additional data automatically charged at $10/1GB. If you use more than 150GB on a single billing account we may continue to charge you at the same rates or restrict your data use until next billing period.

Usage Alerts: Usage alerts are not real-time and delays of up to 48 hours may be experienced.

My Account: Services that share data may have a service login to My Account which will display all service numbers contributing or using the shared data pool on the account, and the amount each service has used. If you have more than 6 services on your account you may not be able to use My Account to monitor usage or add/change alerts.

Premium Support: Excludes Optus DSL, Mobile Broadband and Fleet mobile services. Available when you either bundle your mobile and consumer–grade broadband and office line service or when you sign up to a $130 My Plan Business or My Plan Business Flex plan and over (minimum total cost over 24 months is $3000) or when you have 3 or more mobile and or fixed services on the one account with an ABN or ACN. My Business Fast Lane: Available to customers who sign up or recontract between one and two 24 month My Plan Business (excluding Tech Fund) or My Plan Business Flex mobile services from 6 June 2016 on one account with a valid ABN/ACN. You must enter your eligible mobile number to receive fast tracking in the phone queue when you call customer service on 133 937. My Business Fast Lane is separate from Premium Support and excludes Fleet mobile services.
